Kemper Museum of Contemporary Art acknowledges it resides on the ancestral territory of the Osage, Kaw, and Otoe-Missouria, among other tribal nations forcibly moved to the region such as the Shawnee, Wyandot, Delaware, Potawatomi, Sac and Fox and Kiikaapoi (Kickapoo) nations. We recognize and support the continued vibrancy of Native communities and cultures today who continue to thrive, as well as the inherent sovereignty of tribal nations. We are compelled to serve and advocate for these communities in accordance with our public mission.

Please note that in most cases, Kemper Museum owns only the physical object and does not assume responsibility for intellectual property, including copyright, or any other legal issues involved in the publication and reproduction of items in its collection. 

Kemper Museum’s reproduction permissions or charges do not include any fees due to the copyright owner or administrator (artist, representing gallery, estate, etc.). While the Registration Department will assist the applicant with contact information, it is the responsibility of the applicant to obtain permission from the copyright owner or administrator.

For information on obtaining copyright permissions for reproducing works by artists represented by ARS or VAGA, contact the Artist's Rights Society (ARS): www.arsny.com. Reproduction, including downloading of ARS Licensed works is prohibited by copyright laws and international conventions without the express written permission of Artists Rights Society (ARS), New York.

Image request(s) must be submitted six weeks prior to the date the material(s) are needed to ensure adequate administrative and processing time. The museum's registration department will be in contact with you if additional information is needed, and to discuss any fees or further copyright permissions that may be required.

Gifts of Art

Kemper Museum of Contemporary Art acquires artworks by purchase, gift, and bequest. The museum holds all acquisitions to the same standards of quality, condition, authenticity, provenance, and utility for display and research. The museum accepts donations of artwork to its Permanent Collection that fit within the museum’s collecting sphere and further its mission. Our curatorial staff researches and gives careful consideration to all gifts of art before recommending them for acceptance. Some of these considerations include the museum’s ability to maintain, store, conserve, and display the artwork. Although an artwork may be artistically significant, it may not be appropriate for the museum’s collection for various reasons.

Every gift offer of artwork must undergo a formal review process prior to acceptance of the gift. To begin that process, a high-quality image of the work must be submitted for curatorial review (in the case of a three-dimensional work, views of each side should be submitted) along with complete information about the artist and artwork (including biographical information about the artist, ownership history, any exhibition and/or publication history, and details on its physical condition (and any previous conservation/restoration). This information may be emailed to: curatorial@kemperart.org. 

Do not ship, send, or bring artworks to the museum. museum staff will not receive or acknowledge any unsolicited artworks that are offered in this manner. Inquiries in person or by telephone will not be considered. 

Once our curatorial staff completes its research and review, prospective gifts of art are then presented to our Exhibitions & Collection Committee for approval and recommendation to the museum’s Board of Trustees for final acceptance of the gift. Depending on the amount of research needed and the timing of the Committee and Board meetings, this process can be expected to take a minimum of two months to several months to complete.

The museum does not accept restrictions or conditions on gifts of art related to display, lending, or deaccessioning. 

Donors are encouraged to seek legal and tax advice from their own advisors for all gifts of art. The museum may not advise donors on any legal or tax matters, and is legally prohibited from providing any value estimates or appraisals to donors. In addition, it is the responsibility of donors to arrange and pay for any appraisals required for their tax purposes.

Fractional and Promised Gifts 
In addition to outright gifts, donors of art may also offer fractional (partial gifts) or promised gifts. 

In making a fractional gift of art, the donor transfers a fraction of the entire interest in an artwork to the museum with the promise to transfer the remaining fraction at a future date. Federal tax law imposes numerous conditions on partial gifts made after August 17, 2006, creating certain restrictions in making such gifts, including that the entire interest in the artwork must be given within 10 calendar years of the initial fractional gift. 

In making a promised gift, the donor promises to give an artwork at a future date (during their lifetime or as a bequest). The review process for a promised gift is the same as for an outright gift. (Please note that the donor is not eligible for an income tax deduction until the artwork is actually gifted to the museum.)

Filming and Photography Requests

To inquire about film or photo shoots at Kemper Museum, please review the policy and submit the request form below. 

Requests are reviewed by a standing committee of interdepartmental staff. Approval is dependent on many factors, including scheduling and logistical restrictions, conservation concerns, and availability of staff and resources.

Kemper Museum has standard written agreements that must be executed prior to commencement of a shoot or circulation of any advertisement. The agreements include an express license and warranty for use of Kemper Museum intellectual property. Credit lines, copyright notices, and trademark notices are typically required and specified where relevant. Permission will only be granted for the original purpose listed on the approved request. 

Use of Kemper Museum’s spaces requires a space rental fee, determined by Kemper Museum based on the scope of the shoot. Please note that fees may be waived for media coverage and projects promotes the museum, its mission, and/or its programs at the discretion of Kemper Museum.

All costs for this supervision, and any other disturbance costs, are charged directly to the applicant. You will be notified in advance of museum approval for your plans and informed of any costs related to security, cleaning crew and/or electrical, in addition to membership fee.

Insurance is necessary and expected. All applicants must furnish Kemper Museum of Contemporary Art with a certificate of liability insurance, showing personal liability coverage with a single limit of not less than $1,000,000 per occurrence for bodily and property damage. Kemper Museum of Contemporary Art shall be listed as an additional insured on the certificate of insurance, which must be on file prior to the intended photography date.

Photography and film crews must be accompanied by designated Kemper Museum staff member(s) at all times. 

All equipment and usage must be pre-approved by Kemper Museum staff.

Care should be taken to avoid damaging floors, walls, and artworks.

In the case of damage to artwork, DO NOT TOUCH or attempt to handle the damaged artwork in any way and immediately notify the Kempe Museum staff member(s) who are present.

Hair, makeup, and wardrobe must be completed in a designated area outside the galleries. 

The use of liquids, food, open flames, and other materials potentially hazardous to the artworks is strictly forbidden.

Access is limited within agreed-upon area(s), date(s), and time(s).

Food and drink are only allowed in designated spaces.

Kemper Museum staff will work with the photographer or videographer in advance to design a safe setup of their equipment within the galleries and in relation to the artwork.

All individuals should remain and equipment must be set up at least five feet away from any artwork, including display cases and exhibition furniture at all times. No equipment is to be placed on top of display cases or displayed objects, including exhibition furniture.

No objects may be handled in any way. Works on exhibition must be photographed where they are displayed. All works, wherever located, may not be touched or moved and all persons involved in filming and/or photographing in Kemper Museum are subject to the control and direction of the museum staff at all times.

No signage, works of art can be unframed or unmounted for photographic purposes. Works may only be handled by museum staff. 

Equipment stands must be secured with appropriately-sized weights to prevent tipping. 

Furniture pads must be brought by a photographer or videographer and used underneath all equipment on wood gallery floors.

All extra or backup equipment (lights, cameras, tripods, storage racks, etc.) must be kept in an area designated by museum staff.

The photographer or videographer is responsible for all equipment clean-up and removal at the completion of the shoot.

The use of liquids, food, open flames, and other materials potentially hazardous to the artworks are strictly forbidden within the galleries. 

Set-up may not prevent visitors from entering or exiting any entrance of the museum.

Natural light is preferable to artificial light, which is destructive to certain works of art. Due to the light-sensitive nature of works of art, some types of lights are restricted in the length of time they are in use and/or are not permitted. Kemper Museum Registration Department will identify and advise when and where additional lighting may or may not be used. 

Light-sensitive artworks (works on paper, plastics, textiles, etc.) should be photographed or filmed using only existing gallery light. Auxiliary photo lamps and flash may not be used without approval from Kemper Museum Registrar.

Specific paintings and sculptures may be photographed or filmed using auxiliary photo lamps, provided precautions are taken in the setup of the equipment as detailed below. 

In the case of composite artworks (more than one type of material), the most sensitive material determines the acceptable light exposure.

Kemper Museum owns only the physical artwork, therefore, does not assume any responsibility for intellectual property, copyright, or any other legal issues involved in the publication and reproduction of objects in the collection. Kemper Museum cannot pass any licensing agreements to third parties. All copyright fees are the responsibility of the Requestor. The Collections + Registration department will assist with providing information to contact appropriate copyright holders. 

All images of Kemper Museum grounds or artwork in the spaces must be accompanied by credit line(s). These must be properly and legibly listed in the closing credits of the film and/or in the closing credits of each installment of the production in which the footage produced under this agreement appears. Project-specific credit lines will be supplied by the museum upon request.

The museum reserves the right to request reciprocal use, for in-house publications or online dissemination, of images created that include any parts of the museum or its properties. 

The museum reserves the right to request three gratis copies of any publication that includes images of any parts of Kemper Museum of Contemporary Art or its properties. 

Final Approval
Kemper Museum reserves the right to request and review the final photograph(s) and video(s) before publication or dissemination. If requested, you will not publish or otherwise disseminate until Kemper Museum gives final approval, which will not be unreasonably withheld.

Unauthorized use of the names “Kemper Museum of Contemporary Art,” “Café Sebastienne,” or images of Kemper Museum of Contemporary Art buildings, properties, domain names, exhibition names, artwork, photographs, publications, or other proprietary content is unlawful and will be pursued with appropriate legal action. They may not be used for commercial purposes without the express permission of Kemper Museum of Contemporary Art; this includes the use of images that are lawfully obtained from an outside stock house or other sources.

Terms of Use

Kemper Museum of Contemporary Art provides this website (kemperart.org), our online store (shop.kemperart.org), and our social media platforms (collectively referred to as the “Kemper Museum website”) in support of its charitable and educational mission to exhibit, collect, and engage in a free and welcoming environment for all. By accessing the Kemper Museum website or engaging in any transaction on the Kemper Museum website, you agree to the Terms of Use and Privacy Policy without limitation or qualification. 

Submissions and User-Generated Content
Any submissions or user-generated content you post, or distribute on the Kemper Museum website, or Kemper Museum’s social media properties, including any data or other content, questions, posts, comments, suggestions, or the like, is and will be treated as, non-confidential and nonproprietary. Anything you transmit or post may be used by the museum or its affiliates for any purpose, including but not limited to, reproduction, disclosure (to law enforcement entities or others), transmission, publication, broadcast, and posting. Furthermore, the museum is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Kemper Museum website for any purpose.

It is strictly prohibited to post or transmit any unlawful, threatening, or infringing material that could constitute conduct that would be considered a criminal offense, give rise to civil liability, a violation of the right of privacy or publicity, or otherwise violate law. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply will not cause injury to any person or entity; and that you will indemnify Kemper Museum for all claims resulting from content you supply. The museum takes no responsibility and assumes no liability for any content posted by you or any third party. The Kemper Museum website uses various measures designed to secure information. However, there is no such thing as 100% security. It is important for you to protect yourself against unauthorized access to your password and to your computer. Kemper Museum is committed to protecting the privacy of its website visitors in accordance with applicable laws and regulations. Please note that the Kemper Museum website is not specifically dedicated to children and Kemper Museum does not actively solicit information from children. Children under the age of 12 are required to obtain permission from an adult before submitting information to the Kemper Museum website.

Kemper Museum uses the personal information you provide to us for internal purposes including tracking transactions, analyzing trends, and collecting statistics. We may compile and share aggregate statistics about visitors, customers, traffic patterns, sales, and related site information without any personally identifying information. 

If you have provided us with your email address, we may send you emails in order to alert you to information, events, activities, or programs at or related to Kemper Museum that we believe may be of interest to you. If you do not want us to use your email address to contact you for these purposes, you may send an email message containing your name and email address to communications@kemperart.org.

When you make a donation or purchase or sign up for a program on the Kemper Museum website, we will ask for the information we need to process and/or acknowledge your transaction. This information could include your name, billing and mailing addresses, telephone number, email address, and credit card information. Your credit card information will be sent to our third-party payment card processors and service providers to perform fraud detection and payment processing services. We will securely retain your personally identifiable information for our records, in order to facilitate better customer service.

Use of Third-Party Service Providers
Kemper Museum sometimes retains qualified third-party service providers to better serve our visitors, customers and others who contact us. By submitting your information on the Kemper Museum website, you agree to this. Kemper Museum requires its vendors to maintain the security of the information to which they are provided access and restricts the vendors from using the information in any way not expressly authorized by Kemper Museum.

California Privacy Rights
California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternately, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option to opt out of such information-sharing. Visitor Guidelines

It is the policy of Kemper Museum of Contemporary Art to prohibit harassment of any individual by another person. This code of conduct applies to all Kemper Museum properties, events, and online activities. 

Kemper Museum reserves the right to refuse or revoke admission of any visitor whose conduct violates these guidelines.

Actions or behaviors that are disruptive or potentially harmful to staff, volunteers, or other visitors, including but not limited to verbal abuse, threatening statements, harassment, or discrimination are prohibited.

Sketch and take notes with pencils only. 

No flash photography, tripods, or monopods. Non-flash photography is permitted.
